Terms and Conditions

Seaphire Travel Services, LLC Terms & Conditions By booking your travel arrangements with us, you are agreeing to be bound by the terms of this agreement and any additional terms and conditions of any supplier that are applicable to your booking arrangements. The lead passenger assumes the responsibility of sharing these terms and conditions with each passenger in their group, including payment of all amounts when due. It is the responsibility of each passenger to read our terms and conditions in its entirety. In addition, we reserve the right to modify these Terms and Conditions.

Furthermore, you are aware that there may be new health guidelines required by a state/country, accommodation, airline or any other vendors used in your travel itinerary and understand the risks of traveling as outlined in the below terms, including the health waiver of liability. Government officials in the destinations you visit may change entry requirements, health protocols, and other rules for inbound visitors (including health screens and tests and mandatory quarantines) at their discretion and with little or no advance notice. Seaphire Travel has no control over these decisions and is not held liable should this affect your trip plans or experience.  

YOU MUST READ THROUGH YOUR INVOICE UPON RECEIPT; MISPRINTS, MISSPELLINGS, INCORRECT TRAVEL DATES, ETC. ARE NOT THE RESPONSIBILITY OF SEAPHIRE TRAVEL & SUBJECT TO CHANGE FEES FOR ANY CORRECTIONS AND/OR RE-BOOKING TRIP COMPONENTS AT CURRENT PRICING AFTER YOUR RESERVATION HAS BEEN MADE. YOU MAY BE DENIED BOARDING IF INCORRECT SPELLING ON AIR TICKETS.

*IF YOU HAVE ANY LEGAL ISSUES OR PAST CRIMINAL CONVICTION THAT COULD PREVENT YOU FROM TRAVELING OUTSIDE THE UNITED STATES, IT IS YOUR OWN RESPONSIBILITY TO VERIFY YOUR ABILITY TO TRAVEL IN THE COUNTRY YOU ARE VISITING. SEAPHIRE TRAVEL IS NOT RESPONSIBLE FOR ANY DENIED BOARDING &/OR DENIED ENTRY DUE TO LEGAL MATTERS. EXAMPLES, BUT NOT LIMITED TO: DUI, IRS, ALIMONY, CHILD SUPPORT PAYMENTS, PENDING WARRANTS, LEGAL CONVICTIONS, FEDERAL CHARGES, NO-FLY LIST.

Seaphire Travel acts only as an agent for airlines, hotels, tour operators, and other suppliers of services and shall not be held responsible for any injury, loss or damage caused by accident or event beyond their control, or by any action or negligence of any persons who are not in their employ. Seaphire Travel can accept no responsibility for losses or additional expenses due to delay or changes in air, sea or other services due to sickness, weather, strike, war, Act of God, or other causes. The right is reserved to make adjustments in the itinerary if deemed necessary. Prices are accurate at time of quote and are subject to change until trip is paid.


*PASSPORTS, VISAS & IDENTIFICATION:
EVERYONE, including children & infants, MUST have a VALID passport to travel internationally (NOT a Passport Card). PASSPORT MUST BE IN GOOD CONDITION WITH NO DAMAGE!! Failure to comply with any Passport or Visa requirements will result in denial of boarding, no refunds, no exceptions. Destinations HD is NOT responsible for Passports or Visa's in ANY way. *Additionally, Passports are REQUIRED to be VALID FOR 6 MONTHS from your return date in most countries. Does your passport have at least TWO empty pages left in in? Additional empty pages may be required depending on country, and Destinations HD is not responsible if you do not confirm the requirements with the country(s) you are traveling. PASSPORT CARDS ARE NOT VALID FOR TRAVEL INTERNATIONALLY VIA AIR!

VISAS:
You may need visas for the destinations you plan to visit – without them, you will not be able to enter these countries generally. Visit the U.S. embassies of the countries you plan to visit for the latest information on visas: https://www.state.gov/s/cpr/32122.htm

REAL ID FOR DOMESTIC TRAVEL :
As of Jan. 22, 2018, travelers from some states are no longer able to travel domestically with only their driver’s licenses. BY MAY  3, 2023 - ALL STATES are required to be REAL ID Complaint to fly domestically. You are responsible to check your states requirement to ensure you have the correct ID or Alternate ID that is required for any air travel for your trip. *TRAVELING WITH CHILDREN:
Children under 18 years of age NOT traveling with BOTH parents or legal guardian(s) may need to present a notarized letter from the absent parent/guardian granting permission to travel outside the United States and provide emergency medical care if necessary. Please refer to this website for more information & sample letters: http://www.globetrektravel.com/minortravelforms.pdf or https://help.cbp.gov/app/answers/detail/a_id/3643/kw/custody%20letter%20travel%20children Seaphire Travel IS NOT responsible for lack of compliance to provide proper documentation to airport authorities. It is the responsibility of the traveler & the traveler’s parents/guardians to provide proper documentation to airport authorities. NO refunds or rain checks if you are denied for improper documentation.

*CHANGES TO RESERVATION:
Any changes made to your existing room reservation are subject to the current rates, promotions, and terms at the time of change. Seaphire Travel will charge a $25 per person per change fee, PLUS any supplier/hotel/cruise fees made prior to final payment. Changes after final payment are subject to a $50 per person, per change fee and subject to approval if allowed, PLUS any supplier, hotel, or cruise line fees. TYPICALLY NO CHANGES CAN BE MADE WITHIN 30 DAYS OF TRAVEL. If allowed after 30 days or less, you are subject to a $100 per person change fee, PLUS any additional supplier/hotel/cruise fees.

*FINAL PAYMENT:
The final payment MUST be received NO LATER THAN 45 days prior to departure OR BY THE CONTRACTED DUE DATE LISTED ON YOUR INVOICE. Final payments are NOT automatically charged. Please note your calendar of your final payment date as reminders may not be sent, however we typically send reminders a couple weeks before it’s due to confirm arrangements. You must contact Seaphire Travel to confirm the payment BEFORE DUE DATE OR YOUR TRIP WILL BE CANCELLED WITH NO REFUNDS. Seaphire Travel is not responsible for cancellations due to payments made after this date. Late fees may apply and refunds may not be provided.

*CANCELLATION PENALTIES:
Pertaining to the room portion of your trip; once your reservation is made a $150 per person, nonrefundable penalty will be assessed by Seaphire Travel, PLUS any additional resort/supplier/cruise penalties. The aforementioned is per person or entire room canceling (so if 1 person within the room cancels these same rules apply for that person). Regarding Airline tickets: Most tickets purchased through Seaphire Travel are 100% non-refundable and subject to individual airline penalties/fees (see insurance section below). AFTER FINAL PAYMENT DUE DATE, NO REFUNDS ARE ISSUED FOR ANY REASON - You should purchase travel insurance for coverage on potential reimbursement options. Cruise cancellation policies become more restrictive prior to final payment, so please check the terms on your cruise reservation as you may have additional penalties prior to final.

All the above cancellation terms may be protected with the optional Travel Insurance. If you do not have insurance – natural disasters (such as hurricanes), pandemics like COVID-19, airline cancellation/delays, or cancellations for ANY reason (medical or personal emergencies, cancellation of the wedding, pregnancy's, etc..) DOES NOT relieve you from these penalties. Travel Insurance is an added protection, depending on level of insurance you decide to purchase and the reason for cancelling will depend on coverage benefits. All cancellations must be received in writing.

*CREDIT CARD PAYMENTS:
While we do accept major credit cards including Visa, Mastercard, American Express and Discover, customers must provide a signed charge authorization agreement for every transaction for your trip. Your authorization is a binding agreement for us to charge your card, and as such, you waive any right to a chargeback in the case of cancellation for any cause (excepting fraud), including a force majeure event, as defined herein, and agree to refund policies and procedures as outlined in these terms and conditions. In the event a client attempts to chargeback, reverse or recollect a trip payment already made without our authorization, we reserve the right to collect all additional costs, fees and expenses associated with such chargeback, reversal or recollection, including, without limitation, attorney fees.

*TRAVEL INSURANCE:
Travel Insurance must be purchased WITHIN 14 DAYS OF INITIAL DEPOSIT from when your reservation is made. Insurance does NOT cover items you purchase outside Seaphire Travel (i.e. airfare, tours, excursions etc). Seaphire Travel will provide your insurance quote within your trip invoice to review and approve, prior to making your reservation. Insurance pricing is based on total trip cost per person, age and state in which you live. WE HIGHLY RECOMMEND YOU PURCHASE TRAVEL INSURANCE TO PROTECT YOUR TRIP INVESTMENT AND TO COVER POSSIBLE EMERGENCY MEDICAL NEEDS DURING TRAVEL ABROAD. Please remember that most health insurance policies in the United States do not cover treatments, hospitalizations, or emergency medical evacuations in other countries.

*VACCINATIONS or IMMUNIZATIONS:
You may need proof of vaccinations for the destination(s) you will visit – without it, you may be denied entry. Visit the federal government’s site for health notices and recommended or required immunizations for the countries on your itinerary. Failure to comply with any requirements will result in denial of boarding or entry, and there will be no refunds, no exceptions. Seaphire Travel is NOT responsible for for the lack of the traveler(s) to obtain the proper requirements or documentation. U.S. travelers visit: https://wwwnc.cdc.gov/travel

*AIRLINE SCHEDULE CHANGES & CANCELLATIONS:
Airlines have the right to change flight schedules, flight #, aircraft, flight times & seat assignments due to airline changes within their network. They may even cancel flights entirely. These changes are beyond Seaphire Travel's control. In the event that such a situation occur; Seaphire Travel will do it’s very best to assist you with finding best possible alternate option(s). If the flight time change is minor (2 hours or less) the airline will automatically make the change (airline policies/rules entitle them to legally do so). Seaphire Travel will notify you of major changes. PLEASE NOTE: there may be additional costs to re-book a new flight should the airline cancel or make a major change to your original flight itinerary. Seaphire Travel is NOT responsible for any additional costs or fees imposed by the airlines. It is the responsibility of the passenger to check for last minute airline flight time changes within 24 hours of departure. Seaphire Travel is not responsible for changes that may occur from your original flight departure time. ALWAYS CONTACT AIRLINES FOR CURRENT FLIGHT INFORMATION.

*BAGGAGE FEES:
Due to continual changes in airline baggage policies it is suggested you inquire with your airline's website for up-to-date fees & information. Seaphire Travel is NOT responsible for additional fees incurred for baggage or seating. BAGGAGE FEES ARE NOT PART OF ANY TRAVEL PACKAGE AND ONLY PAYABLE TO AIRLINE DIRECT AT CHECK-IN. Please review the "Checked Bag and Carryon Bag Rules" at www.TSA.gov

*RE-CONFIRM YOUR FLIGHTS:
Seaphire Travel advises you personally re-confirm your flight schedule at least 72 hours prior to departure directly with the airline in case of any last minute changes or delays. Most airlines allow you to check in online 24 hours prior to departure using the “Record Locator” (found in your travel documents, if purchased air through us).

*AIRLINE CHECK IN:
Please check in with your airline at the airport no later than two (2) hours prior to scheduled flight departure time. International travels require three (3) hour prior check-in at the airport. Most airlines require 60-90 mins to be checked-in prior to any flight OR they will deny you travel. Check with your airline to know their terms. Boarding doors will also close 10-15 mins prior to take off.

*HOTEL CHECK IN:
Check-in time at most accommodations is 3:00pm (local time). If you arrive prior to 3:00pm your room may not be ready. The resort will store your luggage in a secure location so you may start enjoying your vacation without delay. Change into something more comfortable and enjoy lunch, swim in the pool, explore, etc. until your room accommodation is ready for check in.

*RESORT DRESS CODE:
**MEN** Be advised most resort restaurants require long pants, collared shirt, & closed-toe shoes. NO shorts, t-shirt, tank-top, flip flops or beach type wear. Please pack accordingly.

*HONEYMOON & ANNIVERSARY TRAVELERS: 
You MUST bring a copy of your marriage certificate to qualify for any complimentary honeymoon/anniversary package (photo copy is recommended). Failure to have such proof may result in the resort denying any complimentary privileges (if applicable). PLEASE notify your travel agent if celebrating a Honeymoon or Anniversary so they can annotate your reservation and inform resort. Typically, resorts will honor these packages up to 30 days before or after your honeymoon/anniversary date. 

*TRAVEL DOCUMENTS:
As part of our “Going Green” initiative in 2020, we no longer mail travel documents, unless necessary based on type of reservation, or requested as a personal preference. Travel documents will be attached within your Mobile Travel App (if part of your travel planning service) and will be provided to you no later than fifteen (15) days prior to departure date. Please read these documents immediately; misprints, misspellings, incorrect dates etc. are not the responsibility of Seaphire Travel Services. Included in your travel documents (if airfare purchased through Seaphire Travel Services) are airline electronic ticket receipts (proof of purchase, NOT boarding passes or actual tickets). Boarding passes are printed at time of check in (online with the airline directly, or at the airport check-in counter).

*DEFINITION OF "FORCE MAJEURE":
In relation to our agency, in any circumstances beyond our reasonable control, (including, but without limitation, to acts of God, explosion, flood, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, sickness, epidemics, pandemics, quarantines, government intervention, weather conditions, defects in machinery and vehicles, delays or other unforeseeable event), we shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, and shall not provide any refund, by reason of delay in performance, or by non-performance, of any of our obligations hereunder to the extent that any such delay or non-performance is due to any force majeure. If our agency, and/or any of our travel suppliers, are affected by force majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to your trip.

COVID-19 & HEALTH WAIVER OF LIABILITY In early 2020, the World Health Organization (WHO) declared the Novel Coronavirus (COVID-19) a worldwide pandemic. If contracted, this virus has the ability to cause the traveler extreme illness, including, but not limited to, death.  You understand that you are taking all risks of traveling with the knowledge of the effects of contracting COVID-19.
 
By booking your travel arrangements with us, you agree that you understand and accept to the following:
 

  1. I am aware that COVID-19 is a highly contagious virus that can be spread via person to person contact;
     

  2. Each vendor, tour operator, and other suppliers of services used by Seaphire Travel Services, LLC may have policies in place to help prevent the spread of COVID-19. Seaphire Travel Services, LLC  is not the creator or holder of those policies and I understand that these policies can change at any time.  
     

  3. Seaphire Travel Services, LLC has provided, within reasonable inquiry, the best available information at the time regarding the current pandemic-protective policies with my travel itinerary.
     

  4. I am responsible for knowing, understanding and abiding by the pandemic-protective policies and procedures regarding COVID-19 of the destination(s) I will be traveling, in addition to, all the suppliers policies within my travel itinerary, including any policy updates;  
     

  5. I understand that all supplier(s) may not apply those policies as diligently as the policies suggest and even if the supplier makes a good faith effort to enforce its good practices, some travelers may simply refuse to cooperate;
     

  6. I understand that by traveling, I can be subject to voluntary or involuntary quarantine either at home or in the traveled location(s);
     

  7. I understand that by traveling, I can be subject to health screenings at multiple stages within my trip, which may require mandatory quarantine or denial of travel, in which any added expenses will be at my own expenditure; 
     

  8. I understand that each state/country institutes their own pandemic-protective policies and regulations, which are subject to change at any time. I further understand that I am responsible for knowing, understanding and abiding by the pandemic-protective policies and procedures regarding COVID-19 of all state(s)/country(ies) listed in my travel itinerary, including any policy updates. I also understand that I may be denied entry into the country for reasons within or outside of my control;
     

  9. With full awareness and recognition of the risks involved, I, for myself, and on behalf of my traveling companions, including, but not limited to, my family, friend, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, assume all risks of travel and hereby forever hold harmless, waive, discharge, and release Seaphire Travel Services, LLC its owners, agents, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 or any other health issues that arise, whether caused by the negligence of the Released Parties or any third-party vendor or supplier partnering with Seaphire Travel Services, LLC. 
     

  10. I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury or harm, death, loss of use, monetary loss, or any other injury from or related to my use of Seaphire Travel Services, LLC services, or the services of Seaphire Travel Services, LLC suppliers or vendors, specifically related to COVID-19 or any other health/medical bearings.

 
By proceeding with my deposit to book my travel arrangements, I acknowledge and represent that:
 

  • I am at least eighteen (18) years of age and fully competent.

  • I have read and understand the foregoing Waiver of Liability and agree to it voluntarily on my own free will.

  • I am sufficiently informed about the risks involved in domestic and International travel regarding COVID-19 and no oral representations or statements, warranties or guarantees, apart from the foregoing written agreement, have been made.

  • I agree that this Wavier of Liability shall be governed by and construed in accordance with Kansas law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Wavier of Liability as a whole.
